TULIKA1200 PRIVACY POLICY FOR CLIENTS
The purpose of this Privacy Policy is to describe which personal data of the Client are processed by TaksokeskusOÜ in the course of the use of TULIKA1200 App and why these data are processed.
The controller of the Client’s personal data processed within the framework of TULIKA1200 App is Taksokeskus OÜ (Taksokeskus), a private limited company registered in the Republic of Estonia under registry code 10297998, with its registered address at Tihase 34, 10619 Tallinn. Taksokeskus OÜ can be contacted by e-mail at info@1200.ee .
DEFINITIONS
(A) Client – a private individual who has accepted the General Terms and Conditions for TULIKA1200 Clients https://www.https://www.1200.ee/en_EE/terms;
(B) Driver – the taxi driver as a private individual who uses 1200Partner App and provides taxi services directly to the Client in the name of the Driver Company as a legal person or sole proprietorship;
(C) Driver Company – a licensed legal person or sole proprietorship providing taxi services, whose Driver or Drivers use 1200Partner App;
1. WHICH PERSONAL DATA DOES Taksokeskus PROCESS?
1.1 Taksokeskus OÜ as a controller processes the personal data that are entered via TULIKA1200 App and other personal data which are necessary for using, hosting, administering and providing user support for TULIKA1200 App.
1.2 Taksokeskus processes the following personal data:
1.2.1 the Client’s e-mail address and mobile phone number entered by the Client when the Client sets up the Client Account on TULIKA1200 Client App;
1.2.2 the Client’s first and last name entered when the Client activates the Client Account;
1.2.3 in case of using the in-app payment, the Client’s credit card and payment information;
1.2.4 the geographic location of the Client or the pickup point entered by the Client, the destination of the ride, the route and duration of the ride, the starting and ending time of the ride;
1.2.5 details of the smart phone on which TULIKA1200 Client App is installed (e.g. the mobile operating system);
1.2.6 feedback submitted by the Client;
1.2.7 data related to the Client’s complaints and disputes;
1.2.8 information about the lost items of the Client;
1.2.9 in case of using the in-app payment, information about the cancellation of orders by the Client.
2. FOR WHICH PURPOSES DOES TAKSOKESKUS PROCESS PERSONAL DATA?
2.1 Taksokeskus processes the following data:
2.1.1 the Client’s first and last name, e-mail address and mobile phone number – to identify the Client and to enable the Driver contact the Client if the Client does not turn up at the pick-up point or if the Client has forgotten any items in the taxi car;
2.1.2 the Client’s credit card and payment information – to calculate the fees payable to Taksokeskus and to enable the Client to pay for the ride via in-app payment;
2.1.3 the location of the Client or the pickup point entered by the Client, the destination of the ride, the route and duration of the ride, the starting and ending time of the ride – to enable the Driver to reach the Client and to enable the Client to check how far the Driver is, which route they are taking, how long the ride was and how much time it took, as well as for resolving any disputes regarding the fee for the ride and the route;
2.1.4 location information in general in anonymised format – to assess the quality and efficiency of the taxi service and to obtain information about the most popular routes;
2.1.5 the Client’s feedback and data related to complaints and disputes – to solve the complaints and to improve the quality of the taxi service provided by TULIKA1200 Companies and Drivers;
2.1.6 information about the Client’s lost items – to return such items to the Client;
2.1.7 information about the cancellation of orders by the Client – to be able to calculate and check the rejection fee charged from the Client in case the in-app payment is used, and to resolve any related disputes.
3. WHAT IS THE LEGAL BASIS FOR PROCESSING THE CLIENT’S PERSONAL DATA?
3.1 Taksokeskus processes the Client’s personal data to enable the Client use TULIKA1200 Client App for ordering taxi services, as regulated under General Terms and Conditions for TULIKA1200 Clients https://www.https://www.1200.ee/en_EE/terms. The personal data processed by Taksokeskus are collected from the Client.
3.2 Taksokeskus may also process personal data based on legitimate interest (e.g. direct marketing, quality check).
4. WHO ARE THE RECIPIENTS OF THE CLIENT’S PERSONAL DATA?
4.1 Taksokeskus discloses the personal data of a Client to the Driver, to the Driver Company under which the Driver operates, to the taxi company managing the respective Driver Company and to the persons providing services to Taksokeskus only for legitimate purposes and in the minimum extent allowing to achieve this purpose:
4.1.1 the Client’s first and last name, mobile phone number and location or pick-up point are visible to the Driver on 1200Partner App, and to the respective Driver Company;
4.1.2 the Driver and respective Driver Company will have access to the Client’s first and last name and mobile phone number within 24 hours after providing the taxi service to contact the Client in the event of lost items;
4.1.3 the Client’s ride information, payment information, feedback and data related to complaints and disputes may be disclosed to the Driver, the Driver Company and the taxi company involved in the Client’s negative feedback, complaint or dispute, and in the event it is necessary also to the persons providing services to Taksokeskus (e.g. provider of IT services).
4.2 Feedback given by the Client is disclosed to the Driver on a no name basis.
4.3 In the event of a payment dispute, Taksokeskus may refer the Client’s contact information, ride information and payment information to a debt collection agency.
5. HOW DOES TAKSOKESKUS PROTECT PERSONAL DATA?
5.1 Taksokeskus takes seriously its duty to protect the data the Clients entrust to Taksokeskus against accidental or unauthorized destruction, loss, alteration, disclosure or access. Taksokeskus uses a variety of security technologies, technical and organizational measures to help protect the Clients’ data. For that purpose, Taksokeskus implements, among other measures, access protocols, use secure protocols and firewalls.
5.2 Taksokeskus enables access to the Client’s personal data to its employees, taxi companies, Driver Companies, Drivers and the persons providing services to Taksoeksus (e.g. IT service providers) in the minimum extent necessary for providing supporting services and to fulfil their obligations in front of the Client and Taksokeskus.
5.3 Taksokeskus processes data also for statistical purposes (e.g. for detecting more popular areas, routes and time periods) in anonymised format.
6. HOW LONG WILL TAKSOKESKUS STORE THE CLIENT’S PERSONAL DATA?
6.1 The data about the rides and orders of the Client (including the data on billing and payments) shall be stored for 7 years after an order is placed by the Client in accordance with the requirements deriving from the Accounting Act, and shall be erased at the end of the respective calendar year.
6.2 The personal data submitted by the Client via TULIKA1200 App, if no orders have been made and no services have been used, shall be stored for up to 2 years after the submission of the data.
6.3 In the event of any circumstances related to an offence or claim, the personal data of the Client may be stored for up to 10 years in accordance with the limitation periods of claims.
7. WHICH ARE THE CLIENT’S RIGHTS REGARDING THEIR PERSONAL DATA?
7.1 The Client can access, change and rectify their personal data by themselves on TULIKA1200 App.
7.2 If the Client would like to submit a request to access, rectify, erase, restrict or object to the processing of the personal data processed on TULIKA1200 App, or if the Client would like to submit a request to receive an electronic copy of the Client’s personal data or for the transmission of such data to another company (to the extent that this right of data portability is provided to the Client by applicable law), the Client is welcome to contact the controller of the data submitted in TULIKA1200 App, Taksokeskus OÜ, by e-mail at info@1200.ee.
7.3 In the request, the Client is asked to make clear which personal data they would like to access, rectify, erase, restrict or object to its processing. For the Client’s protection, Taksokeskus must verify the identity of the Client before fulfilling any such request. Taksokeskus will handle the request as soon as reasonably possible.
7.4 Taksokeskus cannot erase such personal data which Taksoeksus has a legal obligation to process or which are necessary for establishing, exercising or defending of legal claims.
7.5 If the Client has any questions, claims and complaints arising from the processing of their personal data by Taksokeskus, the Client is welcome to contact taksokeskus OÜ by e-mail at info@1200.ee and Taksokeskus will aim to answer your questions and to resolve any issues.
7.6 If the Client is not satisfied with how a certain data protection issue has been resolved by Taksoekskus, the Client has the right to submit a complaint with the Estonian Data Protection Inspectorate by e-mail to info@aki.ee.
